Plain-English Summary
When you register a domain through BrandcastHQ, BrandcastHQ LLC holds the domain registration in our name on your behalf. You receive an exclusive license to use it while your subscription is active. If you cancel, you have 30 days to pay a $750 transfer fee and move the domain to your own registrar. After 30 days, BrandcastHQ may retain, release, or re-assign the domain at our sole discretion.
1. BrandcastHQ as Domain Registrant
All domain names procured through the BrandcastHQ platform (“Platform Domains”) are registered by BrandcastHQ LLC, or its authorized domain registrar agent, as the registrant of record with the applicable domain registry and ICANN-accredited registrar. BrandcastHQ holds legal title to all Platform Domains.
This arrangement is a standard industry practice used by website platform providers to simplify domain management and provisioning on behalf of subscribers. By requesting domain registration through the BrandcastHQ platform, you expressly authorize and instruct BrandcastHQ to register the domain in BrandcastHQ's name on your behalf.
Platform Domains are distinct from domains you independently register at a third-party registrar and subsequently connect to the BrandcastHQ platform (“Connected Domains”). This policy applies only to Platform Domains.
2. Domain Use License
Upon successful payment of applicable domain and subscription fees, BrandcastHQ grants you a limited, exclusive, non-transferable, revocable license to use the Platform Domain for lawful business purposes during your active subscription period (“Domain License”).
The Domain License does not convey any property rights, ownership interest, or equitable title in the Platform Domain to you. You acknowledge and agree that BrandcastHQ retains all right, title, and interest in and to all Platform Domains, including all registration rights.
The Domain License is tied exclusively to your active BrandcastHQ subscription. Downgrading, suspending, cancelling, or terminating your subscription for any reason — including non-payment, voluntary cancellation, or termination by BrandcastHQ for cause — immediately suspends your Domain License, subject to the Transfer Window described in Section 4 below.
3. Domain Registration Fees
Domain registration fees, renewal fees, and any applicable ICANN fees are charged at the rates displayed at the time of registration. Fees are non-refundable once a domain registration has been submitted to the registry, regardless of whether the subscription is subsequently cancelled.
BrandcastHQ will use reasonable commercial efforts to renew Platform Domains on your behalf while your subscription remains active. BrandcastHQ is not liable for domain expiration resulting from failed payment, outdated billing information, or subscription lapse. You are responsible for maintaining valid payment information and an active subscription to ensure domain renewal.
4. Cancellation and Transfer Window
Upon cancellation or termination of your BrandcastHQ subscription for any reason, a thirty (30) calendar day grace period commences immediately (“Transfer Window”). During the Transfer Window:
- Domain License Remains Suspended.Your Platform Domain will not resolve to active web content. The domain will display a maintenance page or be parked at BrandcastHQ's discretion.
- Transfer Request. You may submit a Domain Transfer Request via your account dashboard or by emailing hello@brandcasthq.com. Transfer requests must be submitted before the Transfer Window closes.
- Transfer Fee. A one-time Domain Transfer Fee of USD $750.00 per domain applies to all transfer requests. This fee covers the ICANN transfer authorization, registrar processing, and BrandcastHQ administrative costs. The Transfer Fee is non-refundable once transfer is initiated.
- Transfer Timeline. Upon receipt and verification of payment, BrandcastHQ will initiate the domain transfer to your designated registrar account within five (5) business days. You must have a valid account at an ICANN-accredited registrar to receive the transfer. ICANN mandates a 60-day lock period for newly registered domains, during which transfers cannot be processed; BrandcastHQ will initiate transfer as soon as the lock expires.
- Exceptions.BrandcastHQ may, at its sole discretion, waive the Transfer Fee for subscribers cancelling within 7 days of initial domain registration (“Registration Regret Period”), provided no DNS requests have been served against the domain.
5. Post-Transfer Window Rights
If no valid Transfer Request is received and the Transfer Fee is not paid within the Transfer Window, your Domain License permanently terminates and BrandcastHQ becomes the sole and unrestricted owner of the Platform Domain. BrandcastHQ may, at its sole and absolute discretion:
- Retain the domain for future use by BrandcastHQ
- Release the domain to the general public for re-registration by any party
- List the domain for sale on secondary domain markets
- Re-assign the domain to a new BrandcastHQ subscriber
- Allow the domain registration to expire at the next renewal date
BrandcastHQ is under no obligation to notify you of its intended action with respect to the Platform Domain after the Transfer Window closes. You expressly waive any right of first refusal or claim to the domain after the Transfer Window.
You acknowledge that the value of any business goodwill, brand recognition, or customer traffic associated with the Platform Domain may diminish or be lost entirely if the Transfer Window is not utilized. BrandcastHQ is not liable for any business losses, lost customers, or lost revenue resulting from domain release or re-assignment after the Transfer Window.
6. Prohibited Domain Uses
You may not use a Platform Domain to:
- Infringe any trademark, copyright, or other intellectual property rights of any third party
- Engage in cybersquatting, typosquatting, or bad-faith domain registration under the UDRP or ACPA
- Host, distribute, or link to illegal content, malware, phishing pages, or spam
- Impersonate any individual, company, or government entity
- Violate any applicable law, regulation, or third-party terms of service
- Harass, defame, or defraud any person or entity
BrandcastHQ reserves the right to immediately suspend the Domain License — without notice and without refund — if, in BrandcastHQ's sole determination, the Platform Domain is being used in violation of the above prohibitions, any ICANN policy, any applicable law, or any court order. BrandcastHQ will cooperate fully with law enforcement and judicial authorities in connection with any investigation related to a Platform Domain.
7. Domain Disputes
If a third party asserts a claim against BrandcastHQ or you regarding a Platform Domain (including UDRP proceedings), BrandcastHQ may, at its sole discretion: (a) lock the domain pending resolution of the dispute; (b) comply with any ICANN or registry transfer order; or (c) suspend or transfer the domain pursuant to a court order or settlement. BrandcastHQ is not liable for any business losses resulting from domain lock or transfer pursuant to a third-party dispute.
You agree to indemnify and hold harmless BrandcastHQ from any claims, damages, costs, and attorneys' fees arising out of or related to your use of a Platform Domain, including any third-party claims of trademark infringement or bad-faith registration.
8. No Warranty on Domain Availability
BrandcastHQ makes no warranty that any specific domain name will be available for registration, will remain registered, or will be free from third-party trademark or intellectual property claims. Domain availability searches are provided for convenience and do not constitute a reservation or guarantee of registration. BrandcastHQ is not liable for any failure to register a requested domain or for subsequent loss of a domain due to registry error, third-party dispute, or expiration.
9. Amendments
BrandcastHQ reserves the right to amend this Domain Ownership Policy at any time. Changes will be published at brandcasthq.com/domain-policy and will become effective 30 days after posting. Continued use of a Platform Domain after the effective date constitutes acceptance of the amended policy. If you do not agree to an amendment, your sole remedy is to submit a Transfer Request before the amendment effective date.
10. Governing Law
This Domain Ownership Policy is governed by and construed in accordance with the laws of the State of Texas, USA, without regard to conflict of law principles. Any dispute arising under this Policy shall be resolved exclusively in the state or federal courts located in Harris County, Texas. You consent to personal jurisdiction in such courts.
