Terms of Service

By accessing or using the BrandcastHQ platform, website, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service. BrandcastHQ LLC (“BrandcastHQ,” “we,” “us,” or “our”) reserves the right to update these Terms at any time with reasonable notice.

BrandcastHQ is an AI-powered agentic SaaS platform designed for local businesses. The Service provides artificial intelligence agents that assist with content creation, phone call management, online review responses, local search visibility, financial reporting, and business website management (collectively, the “Agents”). The Agents operate autonomously based on your configurations and business data.

The Service is delivered entirely via software-as-a-service and requires an active internet connection. Features may vary by subscription plan.

You must be at least 18 years of age to use the Service. By creating an account, you represent that you are at least 18 years old, have the legal capacity to enter a binding agreement, and are using the Service for legitimate business purposes. The Service is intended for commercial and business use only, not for personal, family, or household purposes.

You must provide accurate, complete, and current information when creating your account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@brandcasthq.com if you suspect any unauthorized use of your account.

BrandcastHQ will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials. You may not share your account with any third party without prior written consent from BrandcastHQ.

Access to the Service requires a paid subscription. Subscriptions are billed on a monthly or annual basis as selected at checkout. All fees are charged in U.S. dollars and are non-refundable except as expressly stated in these Terms.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. BrandcastHQ reserves the right to change subscription pricing with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Payments are processed by Stripe. By providing payment information, you authorize BrandcastHQ to charge your payment method for all applicable fees.

BrandcastHQ offers a 14-day free trial for new subscribers. A valid payment method is required to start a trial. You will not be charged during the trial period. At the end of the trial, your subscription automatically converts to a paid plan and your payment method will be charged unless you cancel before the trial ends.

Free trials are limited to one per business entity. BrandcastHQ reserves the right to modify or discontinue free trial offers at any time.

You may cancel your subscription at any time through your account settings or by contacting hello@brandcasthq.com. Cancellation takes effect at the end of your current billing period. You retain access to the Service through the end of your paid period.

No refunds will be issued for any unused portion of a subscription after the free trial period ends, except where required by applicable law. If you cancel during a free trial, you will not be charged.

Removal of hosted assets on cancellation. Certain assets are hosted and maintained by BrandcastHQ as part of your active subscription — including your listing and dofollow link in the BrandcastHQ Directory, any website we host on your behalf, and content, articles, press releases or backlinks we publish on our own properties and networks. These assets, and the search-engine visibility and ranking they provide, are part of the Service and are removed or deactivated when your subscription ends. We do not delete or alter content on domains, profiles, or accounts that you own and control. Backlinks or content on third-party websites not operated by BrandcastHQ are outside our control and are not guaranteed to be removed.

You agree not to use the Service to:

• Send unsolicited commercial messages (spam) or violate CAN-SPAM, TCPA, or other applicable laws
• Generate, distribute, or publish illegal, defamatory, or fraudulent content
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Access or attempt to access accounts or data that do not belong to you
• Use the Service in any way that violates applicable local, state, national, or international law
• Engage in any activity that disrupts or interferes with the Service infrastructure

Violation of this section may result in immediate account termination without refund.

The Service uses artificial intelligence to generate content on your behalf, including social media posts, review responses, emails, and other business communications. You are solely responsible for reviewing AI-generated content before publishing or distributing it. BrandcastHQ makes no representations about the accuracy, completeness, or suitability of AI-generated content for any specific purpose.

By using the Service, you grant BrandcastHQ a limited license to use your business data, brand assets, and content to train and operate the AI Agents on your account. This license is non-transferable and used solely for your benefit.

Your use of the Service is subject to our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the collection, use, and sharing of your data as described in our Privacy Policy. You can find our Privacy Policy at brandcasthq.com/privacy.

The Service, including all software, technology, trademarks, and content created by BrandcastHQ, is owned by BrandcastHQ and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes during your active subscription period.

You retain all rights to your own business data and content. BrandcastHQ does not claim ownership of any data or content you upload or create using the Service.

To the maximum extent permitted by applicable law, BrandcastHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service.

BrandcastHQ's total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the total amount paid by you to BrandcastHQ in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless BrandcastHQ LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
